WAIVER OF LIABILITY AND RELEASE
Important: Each Volunteer must sign the “Waiver of Liability and Release” before volunteering with
Flourish Furnishings, Inc.
This Waiver of Liability and Release (the “Waiver and Release”) executed by Volunteer as of the
signature dated below for the benefit of FLOURISH FURNISHINGS, INC. d/b/a/ Flourish Furniture
Bank, a nonprofit corporation organized and existing under the laws of the State of Missouri and its
directors, officers, employees, and agents (collectively, “Flourish”). The Volunteer desires to engage in
activities related to being a volunteer for a work project at or for Flourish.
By signing this form, Volunteer acknowledges that they have read, understand, and agree to the
following terms and conditions related to volunteering their services to Flourish. Volunteer hereby
freely and voluntarily, without duress, executes this Waiver and Release under the following terms:
1. Waiver and Release. Volunteer releases and forever discharges and holds harmless Flourish and
its successors and assigns from any and all liability, claims, and demands of whatever kind or
nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s work at
Flourish. The Volunteer understands and acknowledges that this Waiver and Release discharges
Flourish from any liability or claim that Volunteer may have against Flourish with respect of
bodily injury, personal injury, illness, death, or property damage that may result from
participation on the Flourish worksite. Volunteer also understands that Flourish does not assume
any responsibility for or obligation to provide financial assistance or other assistance, including
but not limited to medical, health or disability insurance in the event of injury, illness, death, or
property damage.
2. Insurance. The Volunteer understands that they expressively waive any such claim for
compensation or liability on the part of Flourish beyond what may be offered freely by a duly
authorized representative of Flourish in the event of such injury or medical expense.
3. Medical Treatment. The Volunteer hereby releases and forever discharges Flourish from any
claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during the Volunteer’s time
with Flourish.
4. Assumption of Risk. The Volunteer understands that their time with Flourish may include
activities that may be hazardous to them including, but not limited to loading and unloading of
heavy furnishings and materials, cleaning, shelving, and unpacking donated furnishings, working
in a busy warehouse, and working around a busy loading dock. Volunteer recognizes and
understands that the Volunteer’s time with Flourish may, in some situations, involve inherently
dangerous activities. Volunteer hereby expressly assumes the risk of injury or harm in these
activities and releases Flourish from all liability for injury, illness, death, or property damage
resulting from the activities of the Volunteer’s time at Flourish.
5. Photographic Release. Volunteer grants and conveys unto Flourish all right, title, and interest
in all photographic images and video or audio recordings made by Flourish during the
Volunteer’s time at Flourish.
6. Other. Volunteer expressly agrees that this Waiver and Release is intended to be as broad and
inclusive as permitted by the laws of the State of Missouri, and that this Waiver and Release shall
be governed by and interpreted in accordance with the laws of the State of Missouri. Volunteer
agrees that if any clause or provision of this Waiver and Release shall be held to be invalid by
any court of competent jurisdiction, the invalidity of such clause or provision shall no otherwise
affect the remaining provisions of this Waiver and Release which shall continue to be
enforceable.
I have carefully read this Agreement and fully understand and agree to its contents. I am aware
that this is a release of liability and I sign it of my own free will.
